CLIENT’S OBJECTIVE
What problem needs to be solved?
The same dispute can fall within different legal categories. The starting point should therefore be not only the area of law, but also the client’s specific objective.

Recover money
Debt, loan, losses, compensation or another monetary claim.

Recover property
Recovery of property, removal of obstacles to its use, or return of property unlawfully withheld.

Establish a right
Ownership, inheritance rights or another disputed civil right.

Challenge a transaction
Invalidity, termination of a contract, or defence against the other party’s claims.

Divide property
Joint marital property, shares, real estate and other assets.

Obtain an inheritance
Formalising inheritance rights and resolving disputes between heirs.

Establish a legal fact
Where a necessary circumstance cannot be confirmed through an administrative procedure.

Defend against a claim
Analysis of claims, objections, evidence and counterclaims.
CIVIL PROCEEDINGS
From dispute analysis to enforcement of the judgment
01
Dispute analysis
Facts, documents, deadlines, claims, litigation prospects and risks.
02
Preparing the position
Selecting the legal remedy, formulating claims and building the evidentiary basis.
03
Interim measures
Where justified, measures to preserve property or the possibility of enforcing the judgment.
04
Court proceedings
Procedural documents, evidence, expert examinations, witnesses and representation.
05
Review and appeal
Appeal and cassation where there are legal grounds.
06
Enforcement
Legal work after judgment where the dispute requires further representation.
EVIDENCE AND STRATEGY
A civil case does not begin with the claim
Before going to court, it is necessary to determine not only what happened, but also which remedy corresponds to the infringed right, what facts must be proved and what evidence can establish them.
Incorrectly formulated claims, a missed deadline, missing evidence or the wrong defendant can affect the entire proceedings. The legal position is therefore developed before the first procedural document is filed.
In complex property disputes, we separately assess the need for expert examination, interim measures, disclosure or production of evidence, and the risks associated with actual enforcement of the future judgment.
Before proceedings begin, we check
✓ the appropriate remedy for the infringed right
✓ the proper parties to the dispute
✓ limitation periods
✓ documents and other evidence
✓ the need for expert examination
✓ grounds for interim measures
✓ counterclaims and objections
✓ prospects for enforcing the judgment

FAQ
Frequently asked questions
Brief answers to questions that most often arise before civil proceedings begin and while a case is being heard.
Can the prospects of a case be assessed before filing a claim?
Yes. This requires reviewing the facts, documents, deadlines, potential claims and evidence available to both sides. Such an assessment is not a guarantee of the outcome, but it helps identify risks and whether litigation is appropriate.
What should I do if a claim has already been filed against me?
The claim and its attachments should be obtained and analysed, the relief sought and evidence reviewed, procedural deadlines checked, and the defendant’s position determined. Depending on the circumstances, a defence, evidence, applications, motions or a counterclaim may be filed.
Can property be frozen before the court issues a judgment?
Where provided by law, the court may be asked to apply interim measures. Whether grounds exist and whether a particular measure is proportionate are assessed in light of the circumstances of the case.
Do I have to attend court in person?
Not in every case. Whether the matter can be handled by a representative and whether personal attendance is required depend on the nature of the dispute, the procedural situation and the actions that need to be taken.
Can a civil dispute be resolved by settlement?
Yes. If the parties reach acceptable terms, the dispute may be resolved by a settlement agreement, subject to procedural law and the client’s interests.
Do you handle cases in other regions of Ukraine?
Yes. Our main practice locations are Kharkiv, Kyiv and Odesa; where necessary, we can also handle civil cases in other regions of Ukraine.
