Article 124 CAO and Article 286 Criminal Code
Two apparently similar accidents can have very different procedural consequences. We distinguish administrative from criminal proceedings and build the defence around the actual consequences of the accident.
Road accident under Article 124
A police report does not by itself establish guilt. We analyse the alleged traffic-rule violation, causation, accident diagram, video, witness evidence and the technical possibility of avoiding the collision.
Accident involving injuries – Article 286
Where bodily injuries have been caused, their severity, causation and the findings of vehicle-technical and forensic medical examinations are crucial. Defence counsel should become involved as early as possible.

Compulsory motor insurance compensation

Insurance compensation after a road accident
Following the reform of compulsory motor insurance, the claims process changed. Where the law permits, an injured party may use direct settlement and claim through their own insurer. Using the European Accident Statement does not automatically mean a small payment: compensation is determined under the applicable insurance rules and the proven loss, within the insured limit.
If an insurer refuses payment, delays the claim or offers an amount inconsistent with the documented loss, we first review the calculation and evidence and then choose the appropriate pre-trial or court remedy.

What really matters in a road accident case
The accident diagram and police report are only part of the evidential picture. In disputed accidents, the documents must be compared with objective data about how the collision occurred.
Photographs and video
Dashcam footage, CCTV and other recordings can help reconstruct vehicle trajectories, traffic signals and the actions of the participants.
Vehicle-technical and trace examinations
The lawyer identifies issues requiring specialist knowledge, formulates questions for the expert and assesses the opinion together with the other evidence.
Assessment of vehicle damage
The amount of damage must be supported by proper calculations and documents. The lawyer organises the evidential work and checks whether the assessment corresponds to the actual damage and legal requirements.

What to do after a road accident

Document the scene
If it is safe to do so, take photographs and video of the vehicle positions, damage, road signs, markings, traffic lights and traces on the road. Identify witnesses and possible video sources.

Do not sign documents you do not understand
Read the accident diagram, report and statements before signing. If you disagree, record your comments and position. Do not admit fault merely because another participant demands it.

Notify the insurer
Follow the required accident notification procedure and keep proof of your notice and submitted documents.

The earlier the initial documents and evidence can be reviewed, the greater the opportunity to preserve important information and avoid procedural mistakes.

Frequently asked questions about road accident cases
The answer in a particular accident depends on the case materials, the procedural status of the participants and the steps already taken.
Do I need a lawyer if the police have already issued a report?
Yes, particularly if you dispute the recorded circumstances or the consequences are significant. The court assesses the evidence as a whole; a police report alone does not determine guilt.
What if I disagree with the accident diagram?
Record your objections immediately where possible. The diagram can later be compared with photographs, video, statements, physical traces and expert evidence.
Can I recover damages exceeding the insurance payment?
In certain cases, yes. The full proven loss, the amount covered by insurance and the legal basis for a claim against the liable person must be established.
What if the liable driver has no valid compulsory insurance?
The circumstances must be reviewed to determine whether an MTIBU regulatory payment is available or whether a direct claim should be brought against the liable person.
When is a vehicle-technical expert examination needed?
It may be needed where specialist knowledge is required to establish the collision mechanism, driver actions, the technical possibility of avoiding the collision or causation. The need for an examination and the questions for the expert depend on the case materials.
Can the accident be documented using the European Accident Statement?
Yes, where the statutory conditions for documenting an accident without calling the police are met. Before using it, make sure the circumstances qualify and all information is recorded correctly.
What should I do if people were injured?
First ensure medical assistance and proper documentation of the incident. For a driver facing potential criminal proceedings, defence counsel should preferably be involved from the earliest investigative actions.
