How to Obtain a Residence Permit in Spain: Where to Start

Spain does not have a single universal residence permit for everyone. First, we need to establish your citizenship, where and on what basis you are staying, your income sources, the purpose of your move, family circumstances and previous application history. These factors determine the type of permit, competent authority, required documents and right to work.

Planning to move

We compare the available routes: remote work, personal funds, employment, self-employment or a family-based procedure.

Already in Spain

We review your current status, eligibility to apply from within Spain, renewals, switching to another category and special arrangements.

Received a refusal or request

We review the complete requerimiento or resolución, response deadlines, supporting evidence and available procedural options.

Important: residence authorisation (residencia), student estancia, temporary protection, an NIE number and the TIE card are not interchangeable concepts.

Main Types of Residence Permits in Spain in 2026

The most popular routes differ in more than cost and validity. The central question is which legal grounds may entitle you to reside in Spain.

REMOTE WORK

Digital Nomad

International remote work for foreign companies; your contract, qualifications, income, social security position and employment status all matter.

NO RIGHT TO WORK

Residencia no lucrativa

Residence based on sufficient funds, without employment or professional activity under this permit; health insurance is required.

CUENTA AJENA

Employed work

A Spanish employer, employment contract and an authorisation procedure with requirements for both employer and applicant.

CUENTA PROPIA / EMPRENDEDOR

Self-employment / company

Authorisation for activity por cuenta propia or a separate entrepreneur route; registering a company alone is not enough.

FAMILY GROUNDS

Family members

Reunification with a foreign resident and routes for relatives of Spanish or other EU citizens involve different procedures and documents.

EXCEPTIONAL GROUNDS

Arraigo

Special regularisation subject to conditions concerning residence, employment, integration, education or other circumstances prescribed by law.

Comparing Residence Routes: Eligibility, Work Rights and Where to Apply

This comparison is guidance, not a fixed instruction for every nationality. These categories can also differ in duration and renewal rules.

No LucrativaSufficient funds without workingNo, under this categoryInitial applications generally go through a consulate

Buying a home, holding an NIE or registering a company does not, by itself, grant the right to live in Spain. The investment Golden Visa programme closed to new applicants on 3 April 2025; transitional provisions apply to previously issued permits.

TWO DIFFERENT FINANCIAL ROUTES

Digital Nomad vs No Lucrativa: Which Route Fits Your Situation?

I WORK REMOTELY FOR FOREIGN CLIENTS

Digital Nomad — Remote Work

For international remote work subject to Ley 14/2013. Authorities examine the nature of your work, foreign client or employer, evidence of the relationship, education or professional experience, financial means and social security coverage. The visa may be valid for up to one year; a residence authorisation applied for from within Spain may be valid for up to three years.

I LIVE ON MY OWN FUNDS

No Lucrativa — Financial Independence

For residence without working under this authorisation. The baseline financial threshold is 400% of monthly IPREM for the main applicant, plus 100% of IPREM for each family member. Evidence of funds, insurance, consular filing and other requirements must be assessed separately.

Do not confuse: the 400% IPREM requirement for No Lucrativa with the financial thresholds for Digital Nomad. Digital Nomad financial criteria are linked to the applicable SMI; amounts and family requirements must be recalculated on the filing date. Professional services for Spanish clients are restricted by law under the special self-employed regime, while different rules apply to employees.

We also assess Seguridad Social, cross-border social security and tax-residency implications separately. A residence permit does not automatically qualify you for a preferential tax regime.

Residence Through Employment, Business or Family

Employment under a work contract

The position and lawful hiring process are central: we review the employer, contract, professional requirements and route for applying. A job offer alone does not guarantee approval.

Entrepreneur or autónomo

Choosing between a standard self-employment authorisation and special business routes requires an assessment of the project. Registering an S.L. without an immigration basis does not replace a residence permit.

Family reunification and relatives of Spanish citizens

Different procedures apply to relatives of foreign residents, Spanish citizens and citizens of other EU countries. We assess the family relationship, eligibility to apply from Spain, funds, accommodation and supporting documents.

Following the 2025 reform, a separate scheme applies to certain relatives of Spanish nationals under Articles 93–98 of Real Decreto 1155/2024. It cannot automatically be treated as ordinary family reunification for foreign residents.

Arraigo, Regularisation and the Exceptional Procedure of 2026

Several arraigo routes require a minimum period of residence of two years, but simply reaching that period does not automatically entitle someone to a permit. Each category has additional requirements and evidence, such as family connections and social integration or an eligible employment contract. Relevant factors include travel history, limits on absences and the applicant’s position in international protection proceedings.

Arraigo social

Authorities assess the duration of stay, family ties to lawful residents or evidence of social integration, together with the applicable financial requirements.

Arraigo sociolaboral

Rules apply to one or more employment contracts, employers and working arrangements. Working hours and employment conditions have legal significance.

Other forms of arraigo

These may include socioformativo, segunda oportunidad and other legally defined cases. The appropriate category depends on previous permits, the educational programme and individual circumstances.

Important as of October 2026: applications under the exceptional regularisation procedure of Real Decreto 316/2026 closed on 30 June 2026. For applications filed on time, monitoring the ongoing case, additional requests and the final decision may still be necessary. New applicants must consider the ordinary routes currently available.

Temporary Protection for Ukrainians and Switching to Other Routes

Temporary protection for people displaced from Ukraine is a special EU mechanism, not an ordinary residence permit based on employment or income. The Council of the EU approved its extension until 4 March 2028. Eligibility, evidence of protection status and transition to other permits must be assessed individually.

Holding temporary protection does not automatically satisfy the conditions for Digital Nomad, No Lucrativa or long-term residence. Any transition requires an assessment of the current status, residence history, income, employment, family documents and applicable special rules at the time of application.

Moving to Spain With Your Family: The Legal Sequence

Moving a family often involves planning residence authorisations, children’s documents, address registration, translations of civil records, insurance and employment or business matters at the same time. Each task has its own competent authority and procedure.

We map the dependencies: what must be completed before entry, what can be handled remotely, where personal attendance is required, when work becomes permitted and which documents will need updating.

Legal content and financial requirements should not be replaced by attractive imagery: the visuals illustrate relocation only and do not depict actual MAGISTERS professionals.

PRACTICAL CHECKLIST

  • Citizenship, valid passport, country of residence and intended place of application.
  • Current visa, residence permit, temporary protection or another basis for staying, if any.
  • Entry and exit history, previous applications, requests and refusals.
  • Purpose of residence: employment, remote income, family, studies or entrepreneurship.
  • Family composition, children’s ages and grounds for including them in an application.

Documents for the relevant route

  • Employment contracts, employer details and evidence of qualifications and work experience.
  • Bank statements, income sources and evidence of personal funds, according to the permit type.
  • Marriage and birth certificates, kinship, financial dependency and cohabitation evidence, where applicable.
  • Health insurance evidence, criminal-record certificates and medical documents, when required.

How Our Legal Support for Spanish Residence Applications Works

The actual scope of work is agreed in advance. Not every procedure allows a representative to complete all actions on behalf of the applicant.

01

Review your circumstances

Establish citizenship, existing status, deadlines and the permitted place of application.

02

Choose the legal route

Compare eligibility grounds, risks, family circumstances and work rights.

03

Build your application file

Agree the documents, translations, insurance and financial evidence required.

04

Prepare the filing

Prepare application forms and submissions to the competent authority under the applicable procedure.

05

Monitor the application

Track notices, respond to additional document requests and observe deadlines.

06

Plan the next stage

Following the decision, clarify TIE arrangements, registration, renewal and conditions for retaining status.

NIE, TIE, Empadronamiento and Work Rights: Key Differences

NIE — Foreigner Identification Number

An identification number used for administrative and financial matters. On its own, it does not confirm residence authorisation or permission to work.

TIE — Physical Residence Card

A card evidencing the legal status granted under the relevant authorisation. Issuing the card is a separate stage; personal biometric enrolment is required for certain procedures.

Empadronamiento — Address Registration

Municipal registration at the place where someone actually lives. It does not replace a visa, residence authorisation or proof of lawful immigration status.

After a favourable decision, the next steps depend on the permit and where the applicant was located when applying. Not everyone needs to obtain a visa, NIE and TIE in the same sequence.

Renewal, Long-Term Residence and Spanish Citizenship

Renewal and changing permit categories

We review deadlines, current eligibility conditions, employment, insurance, family circumstances and any extended absences. The renewal procedure depends on the authorisation category.

Long-term residence (larga duración)

The general rule for national long-term residence is five years of lawful and continuous residence, subject to statutory limitations and exceptions. Not all periods of estancia are counted in the same way.

Spanish citizenship

For most applicants, the ordinary naturalisation requirement is ten years of lawful residence, although special categories and additional conditions exist. Five years of residence does not automatically lead to a Spanish passport.

Periods spent outside Spain may affect eligibility for long-term residence. The counting rules for students and temporary-protection beneficiaries should not be assumed to match those for ordinary residence.

Why Residence Applications Are Refused and What to Do Next

Wrong route or place of application

The procedure does not match the applicant’s status, purpose of travel or the requirements for consular or in-country applications.

Problems with income and contracts

The amounts, income type, employment arrangement, work period or social-security contributions do not meet the programme’s conditions.

Documentation and deadlines

Incomplete evidence, unsuitable translations, unproven family relationships, an unanswered requerimiento or an expired response deadline.

After a refusal, keep the full decision and proof of when it was served. These determine the available administrative remedies, subsequent court proceedings and deadlines. Representation in Spanish courts must be provided by a professional holding the required Spanish authorisation.

How Much Does a Spanish Residence Permit Cost and How Long Does It Take?

Legal support fees

Our professional fee depends on the residence route, family composition, amount of preparation, translation needs, responses to further requests and involvement of external specialists. The scope, estimate and payment stages are agreed before work begins.

Government and additional costs

Consular fees, Spanish administrative charges, health insurance, sworn translation (traducción jurada), apostilles, notarial fees and registration costs are calculated separately. We do not present these as part of a single ‘residence permit price’ without explanation.

Processing times

Legal processing timeframes differ for Extranjería, UGE, consulates and special procedures. Document preparation, the authority’s decision period and the TIE appointment are three separate stages.

We do not promise approval within a fixed number of days or guarantee a favourable government decision. Appointment availability and further document requests depend on the individual case.

Assisting Clients in Alicante, Valencia, Madrid, Barcelona and Throughout Spain

Consultations, document reviews and legal assessments can often be handled remotely, including for people who have not yet entered Spain. Personal attendance at a consulate, police office or another authority will be necessary where the procedure requires it.

ANSWERS TO PRACTICAL QUESTIONS

Frequently Asked Questions About Residence in Spain

Short answers to common situations. They do not replace a review of your documents and the current requirements of the competent authority.

Which residence permit should I choose when moving to Spain?

The appropriate route depends on your purpose, current immigration status, citizenship, income, family relationships and place of application. Remote work, personal savings, a Spanish employment contract and family grounds involve different procedures.

Can I apply for a Spanish residence permit while outside Spain?

Some routes require an initial application through the competent Spanish consulate. Others allow an eligible applicant to apply from within Spain. There is no universal rule.

Can I work with a No Lucrativa permit?

This authorisation is intended for residence without employment or professional activity under that permit. Anyone who wants to work should assess a different legal route; passive income and the nature of any activity require individual review.

How much income is required for No Lucrativa?

According to the official guidance, the baseline threshold is 400% of the applicable monthly IPREM for the main applicant plus 100% of IPREM for each family member. The evidence, accessibility of funds, insurance and consular requirements also matter.

What are the requirements for Digital Nomad in Spain?

Authorities normally examine employment or professional activity for foreign companies, proof of the relationship and income, qualifications or experience, social security arrangements and family documentation. The precise requirements depend on whether you are employed or self-employed.

How long is a Digital Nomad permit valid?

The special remote-work visa can be valid for up to one year, while a residence authorisation applied for from within Spain under the relevant procedure can be valid for up to three years. The actual duration depends on the grounds and supporting evidence.

Can I obtain residence by buying property in Spain?

Buying property does not by itself provide a right to reside in Spain. The Golden Visa scheme closed to new applicants on 3 April 2025; previously issued authorisations are governed by transitional provisions.

Is a student visa the same as a residence permit?

Studies are usually authorised under estancia por estudios, which differs from residencia. Work rights, accompanying family and subsequent status changes are subject to separate rules.

After how many years can I obtain residencia de larga duración?

The general benchmark is five years of lawful and continuous residence in Spain, subject to further requirements including limits on absences. Not all other immigration statuses are counted equally.

Can I obtain arraigo after living in Spain for two years?

Two years alone is not enough. Depending on the arraigo category, an employment contract, family or social ties, integration, education or other evidence may be required. International protection status can affect how the residence period is calculated.

Is the exceptional regularisation programme of 2026 still open?

No. New applications under Real Decreto 316/2026 closed on 30 June 2026. Applications filed on time may still involve additional requests, decisions and follow-up procedures; new cases must be assessed under the routes currently in force.

Is temporary protection for Ukrainians an ordinary residence permit?

No. It is a separate EU legal protection mechanism extended until 4 March 2028. Eligibility and transition to other authorisations are governed by specific rules.

Do I need an NIE before applying for residence?

There is no universal sequence. NIE is a foreigner identification number and does not by itself establish a right to reside or work. Different procedures assign or use it at different stages.

Do all documents need an apostille and sworn translation?

No. Legalisation, apostilles and traducción jurada depend on the issuing country, document type, applicable international agreements and the authority’s requirements.

What should I do if my Spanish residence application is refused?

Keep the complete refusal, proof of the date it was served, previously filed documents and correspondence. A legal review will identify whether defects can be corrected, an administrative appeal is available or court action is appropriate within the legal deadline.

How much do consultations and legal support cost?

Fees depend on the case and scope of work. The services and professional charges are agreed after an initial assessment; government fees and third-party costs are accounted for separately.
