Tourist and Passenger Rights Protection
Legal support for tourists and passengers in Ukraine in disputes with tour operators, international bus and air carriers, hotels and travel insurers.
Tourist and passenger rights protection begins with the specific breach: a cancelled package holiday, ticket refund refusal, denied boarding, lost luggage or travel insurance rejection. We assess the evidence, liable provider and viable remedies.

COMMON PROBLEMS
Legal help for tourists and passengers in common disputes
Legal help for disrupted package holidays, transport services, hotel bookings and travel insurance. Each type of dispute requires its own contractual and legal assessment.
Cancelled package holidays and refunds
The operator will not refund your payment, offers a voucher only, or disputes its expenses.
Denied boarding on an international bus
Denied boarding, removal en route, cancelled service or refusal to refund a ticket.
Cancelled or delayed flights
Missed connections, unused tickets and additional accommodation costs.
Cancelled or dishonoured hotel booking
No room was provided, conditions differed, or a deposit was withheld.
Lost or damaged baggage
The carrier disputes responsibility for your belongings.
Travel insurance claim rejected
Unpaid medical expenses or disagreements about exclusions and documents.
ONE SERVICE, DIFFERENT CLAIMS
Travel disputes and passenger rights in Ukraine
Travel disputes may involve much more than a package holiday refund. A journey may involve an international bus, flight from an EU airport, hotel booking and insurance policy. Different contracts may create separate claims against different service providers.
Tourist and passenger rights claims require review of booking terms, legal deadlines, responsible providers, proven losses and jurisdiction. We prepare demands and represent clients where the law and available evidence justify a claim.
TOUR OPERATORS AND AGENTS
Tour operator disputes and package holiday refunds
Package holiday refunds and travel agency disputes arise where a paid tour is cancelled, key services are missing or the itinerary changes materially. We review the booking contract, travel vouchers, payments, correspondence and evidence of expenses.
Article 20 of Ukraine’s Law on Tourism governs the travel services contract with a tour operator, including agreements made through a travel agent. The particular responsibilities of the operator, agent and payment recipient must still be established from the contracts and facts.
References to martial law, extraordinary circumstances or a non-refundable tariff do not settle the issue on their own. The relevant questions include the timing of the contract and disruption, actual performance, documented expenses and the legal consequences of termination.
The package tour did not take place
We assess termination rights, refund claims and other potentially recoverable losses.
Changes to package travel contracts
We examine changes to dates, itinerary, service quality and the right to reject new terms.
Tour operator and travel agent liability
We identify the contractual roles of the agent, operator and actual payment recipient.
COACH · AIR · RAIL
International bus and air passenger rights
Journeys involving Ukraine often include an international coach to Poland, Moldova, Romania, Slovakia or Hungary, followed by a flight from another country. Each segment may be subject to different legal regimes.
International bus and coach passenger rights
We assist with cancelled services, significant delays, denied boarding, removal from a vehicle, baggage problems, ticket refunds and demonstrable consequential expenses.
Article 56-1 of Ukraine’s Law on Automobile Transport requires international carriers to check documents needed for entry and transit. Whether a boarding refusal was lawful therefore depends on the passenger’s actual documentation and the requirements of the route.
EU Regulation 181/2011 may apply to certain scheduled coach services involving an EU boarding or alighting point, subject to distance and other conditions. Its remedies are not automatically available on every coach journey.
Flight cancellations, delays and denied boarding
We consider refunds, rerouting, assistance during disruption and, where legally available, standardised compensation. EU Regulation 261/2004 covers, in particular, departures from EU airports and certain flights arriving in the EU from third countries operated by EU carriers.
Entitlements depend on the itinerary, operating carrier, notice, cause of the disruption and applicable exceptions. Extraordinary circumstances can affect fixed compensation without necessarily extinguishing all duties to assist or refund.
For lost, delayed or damaged baggage and certain other international air carriage claims, the Montreal Convention may provide a separate framework, including specific notice periods and liability limits.
International rail travel and missed connections
We assess international rail cancellations, ticket refunds and losses arising from missed connections. The relevant operator, route, ticket terms and applicable rail passenger regime must be established.
Buying a coach ticket and a flight ticket separately does not automatically make the airline liable if the coach arrives late. We examine whether the connection was protected, whose breach caused the loss and which mitigation costs were reasonable.
TICKETS, ACCOMMODATION, PLATFORMS
Flight and bus ticket refunds and hotel booking disputes
A service cancelled by the provider is legally different from a voluntary cancellation by the customer. Non-refundable conditions must be read alongside the contract, the information provided before purchase and any overriding legal rules.
For reservations made through Booking, Airbnb, ticket aggregators and other platforms, we identify whether the intermediary is a contracting party, a booking agent or merely a payment facilitator. Responsibility cannot be assigned solely by the name shown on the receipt.
Depending on the case, we consider a contractual complaint, the platform’s dispute procedure, payment card remedies and court proceedings. Chargeback is subject to bank and card scheme rules, grounds and deadlines.
Refunds for cancelled tickets
Cancellation, refusal to carry, changing a booking and refund conditions.
Hotel and holiday rental disputes
Denied check-in, cancelled bookings and deposits withheld for unprovided services.
Online travel booking platform disputes
Identifying the correct counterparty and the potential responsibility of intermediaries.
MONETARY CLAIMS
Compensation for travel disruption and proven financial losses
Where supported by law and evidence, a claim may cover more than the price of the undelivered service. Extra tickets, emergency accommodation, transport costs and unused bookings may be recoverable if they were reasonably incurred as a consequence of a legally relevant breach.
Each head of loss requires proof of the amount, applicable legal basis, responsibility and causation. Inflation adjustments and statutory interest under Article 625 of Ukraine’s Civil Code are not universal additions to every travel complaint; their application depends on the nature of the monetary obligation.
Non-pecuniary damage also requires a legally recognised basis and evidence of actual adverse consequences. A disappointing or cancelled trip does not guarantee any particular court award.
| Possible claim | Evidence to consider |
|---|---|
| Refund of the principal payment | Booking contract, ticket, payment records and evidence of non-performance. |
| Additional expenditure | Receipts, bank statements, reasonableness and causal connection. |
| Lost or damaged baggage | Baggage documentation, timely notice, item values and carrier records. |
| Non-pecuniary damage | Applicable basis, relevant consequences and supporting evidence. |
INSURANCE AND PERSONAL INJURY
Travel insurance disputes, rejected claims and personal injury
Where an insurer refuses medical expense reimbursement or relies on a policy exclusion, we examine the wording of the cover, claims notification requirements, medical records and the stated reasons for refusal.
Where injury occurs during an organised excursion, transport or accommodation, the insurer’s obligations must be distinguished from potential liability of the organiser, carrier, hotel or direct wrongdoer. Having insurance does not always rule out a separate damages claim.
Foreign medical records may require translation and separate analysis of the law governing the event. We review the available evidence and practical routes to recovery before recommending litigation.
Travel insurance claim payments
Denied medical expense claims and disputed exclusions.
Personal injury
Claims arising from accidents during transport or organised activities.
Lost luggage claims
Interaction between insurance policies and carrier liability.
BEFORE BRINGING A CLAIM
When can travellers claim refunds or compensation?
Not every disruption is a contractual breach, and not every breach makes all consequential costs recoverable. The starting point is to identify the responsible party, legal basis, evidence and proportionality of any proposed action.
Litigation over a modest ticket price may be commercially unreasonable. A failed family holiday involving multiple tickets, accommodation and documented extra expenses calls for a different assessment, including enforceability against the defendant.
The responsible party
Operator, agent, actual carrier, hotel, platform or insurer.
Applicable law
Ukrainian law, foreign law, international convention or specific EU rules.
Available evidence
Contracts, receipts, messages, carrier records and loss documentation.
Effective forum
Jurisdiction, deadlines, defendant location and enforceability.
HOW OUR LAWYERS HELP
How tourist and passenger claims are handled
Assistance may involve a targeted legal assessment and a formal demand, or full litigation and post-judgment enforcement. The scope is agreed once we have reviewed the documents.
Contracts and itinerary
Identify obligations, time limits and applicable legal rules.
Proper defendant
Distinguish the operator, agent, carrier, platform and insurer.
Quantifying the claim
Separate the purchase price from additional losses and potential compensation.
Demand and negotiation
Prepare a reasoned complaint and seek practical settlement.
Representation in court
Prepare the claim and evidence and appear before a competent court.
Enforcement assessment
Review the practical means of recovering funds after judgment.
EVIDENCE
Documents required for travel and ticket refund claims
Preserve digital tickets, booking confirmations and notifications; do not delete messages. Some types of transport and baggage claim have short notice periods, so documenting the incident promptly matters.
- travel service agreements, itineraries, fare rules, vouchers and booking details
- tickets, boarding passes, baggage tags and proof of payment
- notices of cancellation, delay, denied boarding or changed terms
- communications with the tour operator, carrier, hotel, platform and insurer
- receipts for replacement tickets, overnight stays, transfers and other costs
- baggage incident reports, photographs, medical invoices and insurance documents

FREQUENT QUESTIONS
Frequently asked questions about tourist and passenger rights
How can I claim a refund for a cancelled package holiday?
Potentially, depending on the agreement, cancellation circumstances, payments made, services delivered and the operator’s properly documented expenses.
Is the tour operator or the travel agent responsible?
Their respective roles must be established from the contract and facts. Selling a package through an agent does not automatically make the agent solely responsible for its delivery.
What if my international bus was cancelled or I was denied boarding?
It depends on the reason for refusal, booking conditions, required entry and transit documents and available evidence.
When does cancelled flight compensation apply?
Sometimes. We check whether EU Regulation 261/2004 applies, the itinerary, operating carrier, notice period and reasons for cancellation. A refund and fixed compensation are distinct rights.
Who pays if a delayed coach causes me to miss a flight?
There is no automatic rule. We examine separate or protected bookings, the coach operator’s breach, causation, foreseeable loss and reasonable mitigation.
Can I obtain a refund for a cancelled hotel booking?
Possibly, depending on who cancelled the booking, whether the stay was provided, the contract and applicable mandatory law.
Can I claim a replacement flight and extra hotel costs?
Where the law permits and the loss, reasonable expenditure, breach and causal link are evidenced.
Can I recover non-pecuniary damage for a ruined holiday?
In legally recognised circumstances, but the claim and amount require a proper basis and evidence of actual consequences.
What if travel insurance refuses to cover foreign medical treatment?
Preserve the policy wording, terms, medical documentation, invoices and insurer’s response. The stated exclusions and claims procedure require review.
Can I sue a foreign airline or carrier in Ukraine?
In some cases, but Ukrainian nationality does not automatically establish jurisdiction. International private law, treaties, the contractual forum and enforceability matter.
RELATED LEGAL SERVICES
Related legal services and border refusal disputes
Claims for contractual breaches, recovery of funds and compensation for harm may also fall within MAGISTERS’ wider civil litigation practice.
A trip disrupted by an allegedly unlawful refusal of permission to cross Ukraine’s state border involves a separate challenge to the border authority’s decision and potentially resulting damages. It is not treated here as an ordinary dispute with a transport provider.
