How to Get UAH 100,000 After an Injury if Your Military Unit Refuses to Pay

Eligibility, repeat hospital treatment, required documents and legal remedies

A service member was wounded while defending Ukraine and is receiving treatment, but their military unit has not accrued the additional remuneration of UAH 100,000. In other cases, payments began but stopped after a subsequent hospital admission. Such situations require more than an explanation for the refusal. It is necessary to examine the documents on which the military unit bases its decision about eligibility.

First, it is important to distinguish additional remuneration during inpatient treatment from payments during medical leave after a severe injury and from other components of military pay. These entitlements have different legal grounds and conditions.

Who Is Entitled to UAH 100,000 After Being Wounded

The legal framework includes Resolution No. 168 of the Cabinet of Ministers of Ukraine dated 28 February 2022, the Law of Ukraine on Social and Legal Protection of Service Members and Their Families, statutory provisions governing additional remuneration during martial law, and departmental military pay procedures. For members of the Armed Forces of Ukraine, Ministry of Defence Order No. 260 of 7 June 2018 is particularly relevant. Law of Ukraine No. 4954-IX of 19 August 2026 also amended the statutory rules, expressly providing for monthly additional remuneration of UAH 100,000 under specified conditions during inpatient treatment following an injury or medical leave following a severe injury. Claims concerning earlier periods must be assessed under the legislation in force at the relevant time.

Additional remuneration of UAH 100,000 calculated on a monthly basis is available, among other circumstances, during inpatient treatment for wounds, concussions, injuries or other bodily harm connected with the defence of Ukraine. Time spent transferring between healthcare facilities may also count. Medical leave following a severe injury is a separate qualifying ground, subject to appropriate medical confirmation.

Important. UAH 100,000 is a monthly reference amount, not a guaranteed lump-sum payment merely for being wounded. The amount for part of a month is determined under the applicable rules and the documented qualifying period.

The dates of the disputed payments also matter. The regulations have changed, including during 2026. Entitlement for earlier periods must be assessed under the versions of the relevant legal acts in force at the time, rather than solely under their current wording.

Why a Military Unit May Refuse to Pay UAH 100,000 After an Injury

Possible reasons include a missing certificate describing the circumstances of the injury, incomplete records of treatment dates, an unresolved causal connection between the injury and the defence of Ukraine, or inconsistencies between hospital records and findings of the Military Medical Commission (MMC).

A military unit may consider subsequent treatment unrelated to the original injury or refuse payment because a later hospital discharge report describes an illness arising from the injury. Such a position cannot be properly assessed without examining the medical evidence and the causal connection.

Cases involving outpatient treatment or leave must be assessed separately. Receiving medical care outside a hospital does not, by itself, establish entitlement to UAH 100,000. Special conditions apply to medical leave following a severe injury.

Can You Receive UAH 100,000 for Repeat Hospital Treatment

Yes. A subsequent hospital admission may qualify for additional remuneration if the treatment relates to an earlier injury sustained while defending Ukraine and the connection is supported by appropriate medical evidence.

In its judgment of 19 March 2026 in case No. 600/367/24, the Supreme Court considered a service member who underwent further inpatient treatment for conditions resulting from an earlier acoustic blast injury. The Court explained that the applicable rules do not require uninterrupted hospitalization from the date of injury. What matters is the connection between the initial injury and the defence of Ukraine, together with medical evidence linking the later treatment to that injury.

The Court also rejected the formal argument that a later date on an MMC decision automatically eliminates entitlement for earlier treatment periods. This does not mean that every subsequent hospitalization qualifies for the higher remuneration. The relevant causal connection must still be established.

Is UAH 100,000 Payable During Treatment Abroad

Inpatient treatment at a foreign healthcare facility may qualify for additional remuneration. Being outside Ukraine is not, in itself, grounds for refusal if the other statutory requirements are met.

The practical difficulty is often proving the dates of admission, the nature of the treatment and its connection to the injury. Keep discharge summaries from foreign hospitals, transfer records, referrals and other documents showing continuous or separate periods of inpatient care. Ukrainian translations may be needed.

Does Payment Continue During Medical Leave After a Severe Injury

Entitlement during medical leave after a severe injury is distinct from entitlement during inpatient treatment. Evidence of the severity of the injury and proper authorization of the medical leave are important.

For Armed Forces personnel, the procedure approved by Ministry of Defence Order No. 260 requires relevant medical findings that the command uses when deciding on medical leave and remuneration. A leave order alone may therefore be insufficient without examining the medical grounds for that leave.

What Documents Are Needed to Obtain Payment

To establish eligibility, collect evidence not only of the injury itself but also of the specific treatment periods and the reasons that treatment was required.

DocumentWhat it establishes
Certificate describing the circumstances of the injuryHow the injury occurred and its connection to the defence of Ukraine
Military Medical Commission decisionMedical causation and other findings made by the commission
Hospital discharge summaries and clinical recordsDiagnoses, dates of inpatient treatment and the connection to the injury
Hospital transfer recordsPeriods spent transferring between healthcare facilities
Medical assessment of injury severity and leave documentsGrounds for payment during medical leave after a severe injury
Payslips, remuneration statements and military ordersWhich amounts the unit did or did not accrue for particular periods

The need for any particular document depends on the case. If a document is held exclusively by the military unit, this does not prevent a service member from protecting their rights. It can be requested through the appropriate procedure, and the court may be asked to order its production.

What to Do if the Military Unit Does Not Accrue the Payment

First, establish the exact unpaid periods. Compare the dates of inpatient treatment, transfers between hospitals, medical leave following a severe injury and the remuneration actually accrued.

Next, submit a written request to the command asking it to review the basis for payment, explain the non-payment and provide the relevant documents. Identify the specific treatment dates, medical records and periods for which remuneration was withheld.

If the problem is missing medical records or an unrecognized subsequent hospitalization, attach the relevant copies. If the unit disputes entitlement itself, assess whether that position is lawful and identify the appropriate judicial remedy.

Practical advice. Do not rely solely on verbal explanations from the finance office. A written reply or proof that a request was submitted helps establish the military unit’s position and prepare evidence for court.

How to Recover Unpaid UAH 100,000 Through Court

Disputes between service members and military units concerning additional remuneration are generally heard by administrative courts as public-law disputes arising from military service.

Depending on the circumstances, a claim may seek a declaration that the unit’s refusal or failure to act was unlawful and an order requiring it to calculate and pay the remuneration due for specified periods. The requested remedy should reflect whether a formal refusal was issued, whether the payment was simply not accrued and what evidence is available.

The time limit for bringing an administrative claim must be checked separately. In disputes over military service payments, the applicable limitation period depends on the nature of the claim, the period in dispute and legislative changes. It is unsafe to assume a universal deadline without reviewing the relevant dates.

Key evidence may include the injury circumstances certificate, MMC decision, hospital records, treatment dates and documents showing remuneration calculations. Where necessary, ask the court to obtain records from the military unit.

Supreme Court Case Law on Payments Following Injury

Repeat Hospitalization and Treatment of Injury-Related Conditions

In case No. 600/367/24, decided by the Supreme Court on 19 March 2026, the central issue was the causal connection between a combat injury and subsequent inpatient treatment. The Court rejected a formalistic approach that excluded payment solely because of a gap between hospitalizations or because medical records used the word “illness” for consequences of the original injury.

The Supreme Court allowed the service member’s cassation appeal, set aside the appellate judgment and reinstated the first-instance decision partially granting the claim. The practical lesson is that a claimant must document both the length of subsequent treatment and its medical connection to the initial injury. If that connection is established, a gap between hospitalizations alone is insufficient grounds for refusal.

Why a Court May Refuse the Claim

Not every non-payment is unlawful. A court may dismiss a claim where the connection between the injury and the defence of Ukraine has not been established, inpatient treatment during the disputed period is undocumented, or payment is claimed for time that does not meet the statutory requirements.

Difficulties also arise when medical records do not show that subsequent treatment addressed consequences of the combat injury. Before filing a claim, it is therefore important to review the full medical history as well as the financial records.

Legal Assistance for Service Members in Payment Disputes

In disputes over UAH 100,000 following injury, the most difficult issue is often not calculating the amount but proving entitlement for each relevant period. An incorrect assessment of an MMC finding, the type of treatment or the hospitalization dates can affect the outcome.

A MAGISTERS military lawyer can review the reasons for refusal, obtain relevant documents, prepare a legal position and represent a service member before an administrative court.

Conclusion

If a military unit does not pay UAH 100,000 following an injury, first establish the legal basis for the payment, the exact treatment periods and the medical evidence linking that treatment to an injury sustained while defending Ukraine. Subsequent hospitalization does not automatically extinguish entitlement. Where a military unit unlawfully refuses payment or fails to act, the entitlement may be enforced through administrative court proceedings.
