CRIMINAL DEFENCE FOR SERVICE MEMBERS

AWOL and Unauthorised Absence Lawyer in Ukraine

Facing an investigation for absence without leave, an Article 407 charge, or difficulties returning to military service? MAGISTERS reviews the facts, the evidence and the lawful return procedure, and provides criminal defence.

We assist service members in communications with the Military Law Enforcement Service (VSP), the State Bureau of Investigation (DBR), commanders and courts. We assess whether Article 401(5) of the Criminal Code may apply and how medical or other documented circumstances affect the case.

WHEN TO GET LEGAL HELP

When you need a lawyer for absence without leave

A service member may have left a unit, failed to return after hospital treatment, received a call from investigators or discovered an entry recording unauthorised absence. The number of days away is only one factor. The defence must establish the person’s military status, the timeline, the reason for non-attendance and the evidence relied upon by the authorities.

Family members can help gather documents, but criminal proceedings require representation by a qualified defence lawyer. Involving counsel before an interview or formal notice of suspicion can protect procedural rights and prevent incomplete explanations from becoming the basis of a mistaken case theory.

ARTICLE 407 OF THE CRIMINAL CODE

Unauthorised absence from a military unit under Ukrainian law

Article 407 of the Criminal Code of Ukraine addresses unauthorised departure from a military unit or duty station and certain failures to report for duty on time without valid reasons. The applicable provision depends on military status, duration, circumstances and the law in force when the event occurred. Martial-law circumstances may have important consequences for criminal liability.

An administrative entry marking a person as absent does not itself establish every element of a crime. We examine orders, attendance records, command reports, the internal inquiry, medical evidence and attempts to contact superiors. The relevant facts include both departure from duty and any subsequent inability to return.

Dates and circumstances

02 / MAGISTERS

Valid reasons

ARTICLE 408 DESERTION

The legal distinction between AWOL and desertion

Desertion under Article 408 requires proof of a particular intent to avoid military service altogether, rather than a temporary absence. In its judgment of 1 December 2022, case No. 297/2178/21, the Supreme Court of Ukraine emphasised this difference in the mental element. The length of absence alone is not conclusive.

Our lawyers assess contacts with command, efforts to return, reports, medical circumstances and other objective conduct. Voluntary return does not automatically remove the possibility of a desertion charge, but prosecutors must prove the legally required intent for that offence.

RULES AFTER 20 SEPTEMBER 2026

How voluntary return after AWOL works in October 2026

Ukraine’s temporary simplified return programme applied to absences recorded no later than 12 June 2026, with applications due by 20 September 2026. That scheme permitted eligible applicants to select a unit from an approved list. The programme has ended. Voluntary return now follows the general process involving the Military Law Enforcement Service and reserve battalions.

A service member may contact the relevant VSP office for information and assignment documents or, where permitted, report directly to a designated reserve battalion. The arrival date and subsequent orders should be recorded carefully. Returning to service is an important step, but it does not by itself terminate a criminal investigation.

ARTICLE 401 PARAGRAPH 5

Relief from criminal liability for a first AWOL offence

Article 401(5) provides a special possibility of release from criminal liability for a person who, during martial law, committed an offence under Article 407 or 408 for the first time, voluntarily petitioned the investigator, prosecutor or court to continue service and obtained the commander’s written consent. The statutory procedure and a court decision remain necessary.

We prepare the application, verify the command approval and examine whether earlier separate incidents may prevent this relief. Where a court grants the appropriate release, the procedural rules also address restoration to service and reporting to the designated unit or duty station within 72 hours after the decision takes effect. This mechanism is not a right to discharge from military service.

01 / MAGISTERS

First offence

Review of separate incidents, not simply the absence of a prior conviction.

02 / MAGISTERS

Voluntary application

Proper documentation of the request to continue service.

03 / MAGISTERS

Written approval

Examination of the commander’s consent and authority.

REPEATED AWOL

What happens if there has been more than one unauthorised absence

In its judgment of 22 July 2026, case No. 731/585/25, the Supreme Court found that two distinct periods of unauthorised absence not linked by a single intent prevented the special release available for a first offence. A statement that someone has never previously been convicted is therefore not sufficient to establish eligibility.

Where a unit recorded more than one absence, counsel should examine whether there were genuinely separate incidents, when service resumed and how each period was documented. Even if the special release is unavailable, the defence may still challenge the evidence, qualification and procedural legality of the accusation.

MEDICAL CONDITIONS AND VALID REASONS

Hospital treatment and medical evidence in AWOL cases

Some cases involve an injured or seriously ill service member unable to return from hospital, unable to travel independently or unable to obtain a necessary referral from command. Relevant evidence may include hospital discharge records, treatment instructions, medical commission findings, written reports and attempts to notify the unit.

A medical certificate does not automatically justify every day of absence. The dates, clinical condition and practical ability to report for duty must be examined. Conversely, investigators should not disregard material evidence of serious illness solely because written command permission is missing. We request relevant records and seek expert assessment where appropriate.

INTERNAL MILITARY INVESTIGATION

Reviewing the military unit’s evidence of absence

A military unit records an absence, takes initial steps to establish the service member’s whereabouts and may conduct an internal investigation. Command reports, personnel records, movement orders, VSP notifications and treatment records may all be significant. Administrative records and admissible evidence in a criminal case serve different purposes.

We seek the relevant materials through lawful legal requests and procedural applications, comparing accounts and dates. In some matters a service member was incorrectly recorded as absent while receiving inpatient treatment or moving under a valid service order. Those situations require documentary verification.

STATE BUREAU OF INVESTIGATION

Criminal defence during investigation and detention

Once an investigation is registered, authorities may request records, interview witnesses, notify a suspect of charges or apply for pre-trial restraint. A command-level search for an absent service member is distinct from the formal procedural search for a suspect. We establish the client’s actual legal status and the orders in force.

The defence lawyer attends questioning, examines the legality of detention, requests evidence, challenges procedural violations and responds to prosecution motions. Where the client wants to resume service, we also coordinate necessary contact with the VSP and command without confusing the military return process with criminal-case resolution.

SUPREME COURT CASE LAW

Court representation and recent judicial decisions

At trial, we examine the alleged period of absence, the service member’s status, evidence of intent, reasons for non-attendance and the admissibility of prosecution materials. Where Article 401(5) applies, the relevant procedural request can be made. Otherwise we may challenge the factual basis, legal classification or sufficiency of proof.

In case No. 638/20690/23, judgment of 13 August 2026, the Supreme Court assessed voluntary return and written command approval, including evidence from a reinstatement order. In case No. 731/585/25 the Court considered repeated absence. The significance of each decision depends on the facts of the particular case.

RETURN TO A DIFFERENT UNIT

Can a service member choose a new unit after AWOL

The previous right to choose a unit under the temporary simplified programme ended in September 2026. Under the general process, recommendations from combat units designated for priority staffing may be considered by reserve battalion commanders, but a recommendation is not a guarantee of assignment.

We examine written approvals, proposed placements and the applicable transfer rules. Later transfers, medical reassessment or discharge on lawful grounds are separate questions and should not be presented as automatic outcomes of returning from AWOL.

PAY AND SERVICE RECORDS

Restoring military pay following a lawful return

Reporting to the VSP does not automatically reinstate every element of military pay. Registration and service orders must be reviewed, including the date of resumption and communication between units. A period of unauthorised absence is not treated like an ordinary period of active duty for remuneration.

Once the return has been properly recorded and qualifying service resumed, relevant entitlements can be reviewed. If payments due for a subsequent eligible period are missing, we examine administrative remedies and potential court proceedings.

DOCUMENT CHECKLIST

Documents to send to an AWOL defence lawyer

Useful materials include the absence timeline, military identification and assignment orders, service reports, communications with command, medical and military medical commission records, DBR letters, VSP documents, reserve-battalion orders and any court papers. A notice of suspicion or indictment should receive immediate attention.

If some documents are missing, you can begin with a dated account of events. We determine which records should be requested and which evidence needs to be preserved before interviews or court deadlines.

MAGISTERS DEFENCE STRATEGY

How our lawyers handle AWOL cases

We first establish the client’s legally achievable objective: contesting criminal allegations, documenting valid reasons, seeking relief under Article 401(5), or arranging a lawful voluntary return. Each route involves different evidence, officials and court steps.

We review records, agree on a defence plan, prepare legal requests and motions, work with relevant military and investigative authorities, and appear in court. No lawyer can guarantee that charges will be dropped or a particular unit will accept a service member; our work is grounded in documents and the applicable law.

FAQ / MAGISTERS

Frequently asked questions about military absence

What is AWOL under Ukrainian law?

Unauthorised departure from a military unit or duty station, and certain failures to report, may constitute an offence under Article 407 of the Criminal Code.

Can I return after 20 September 2026?

Yes. The temporary simplified programme ended, but voluntary return continues under the general rules involving the Military Law Enforcement Service and reserve battalions.

Does returning automatically close the criminal case?

No. Release from criminal liability requires the applicable statutory conditions and a formal court decision.

What are the requirements under Article 401(5)?

A first Article 407 or 408 offence during martial law, a voluntary application expressing the intention to continue service, written commander approval and the required court process.

What if there were two separate periods of absence?

The Supreme Court ruled in case No. 731/585/25 that separate repeated incidents may exclude the special relief for a first offence.

How is AWOL different from desertion?

Desertion requires an intent to avoid military service altogether. Duration of absence alone is not conclusive.

Can I choose a different military unit?

The previous simplified choice programme ended. Certain recommendations from priority combat units may be considered, but placement is not guaranteed.

Will hospital records help?

They may be important evidence of relevant circumstances. Dates, functional limitations, treatment and efforts to inform the unit all matter.

Is failing to return after medical treatment AWOL?

It can be relevant under Article 407 if the statutory elements are met and no valid reason explains the absence. The facts must be examined.

Do I need to speak to DBR investigators?

This depends on the legal status and applicable procedural requirements. A defence lawyer should review summonses and investigation decisions.

Will military pay restart on return?

Entitlements depend on proper recording of the return and subsequent service. The period of unauthorised absence is treated differently from active service.

What if my unit recorded AWOL by mistake?

Preserve treatment records, valid orders and location evidence, and challenge inaccurate records through the appropriate procedures.

Do you assist clients in Kyiv Kharkiv and Odesa?

Yes. Initial review and document sharing may be arranged remotely, with representation as required.

Can you guarantee that I will avoid prosecution?

No. Any decision depends on the evidence, applicable law and competent authorities. We evaluate the available lawful defence options.
