UNDERSTANDING THE PROBLEM

What is a notarial enforcement writ in Ukraine

A notarial enforcement writ is an enforceable document which, in the situations allowed by Ukrainian law, enables a creditor to request enforcement without first obtaining an ordinary debt judgment. People may first learn of the writ when a bank account is frozen, salary deductions begin or an enforcement officer sends a formal order.

The existence of a writ does not establish that every element of the creditor’s demand is correct. A court can examine whether the debt actually existed, was undisputed, was calculated properly and was supported by the documents the notary was legally required to review.

01 / BANKING

Your bank account is frozen

A Ukrainian bank has restricted your account because of enforcement proceedings you may not have known about.

02 / DEDUCTIONS

Salary or pension is being deducted

An enforcement officer has issued instructions to deduct funds based on a notarial writ.

03 / LOANS

A finance company purchased your debt

The person collecting changed, the total increased and supporting documents are incomplete or disputed.

04 / PROPERTY

Property may be at risk

Mortgage or notarised loan documents require a separate check of their specific statutory requirements.

GROUNDS FOR A CLAIM

When a notary enforcement writ may be challenged

Potential grounds include a disputed debt or calculation, insufficient documentary evidence, failure to follow a required notification procedure, or issuing a writ for an agreement not eligible for this process. We analyse Articles 87 and 88 of Ukraine’s Law on Notaries, Resolution No. 1172 and the rules in force on the date of the writ.

A general denial of liability does not automatically resolve the case. The court considers the agreement, creditor records, payment history, expiry dates and whether there was a genuine dispute over the debt or its amount when the writ was made.

01 / AGREEMENT

Non-notarised consumer credit

We check the restrictions applicable to ordinary bank loans and online microloans as well as the date of the writ.

02 / DISPUTED AMOUNT

The amount is not properly evidenced

A lender’s unilateral statement is not always adequate proof of an undisputed sum.

03 / NOTICE

Required notices were missing

For qualifying notarised agreements and mortgages, we examine demand letters, deadlines and proof of service.

04 / TIME LIMITS

The legal period may have expired

We assess when the creditor’s right arose and the applicable statutory period for requesting a writ.

CURRENT UKRAINIAN LAW

Notarial enforcement writs on loans during martial law

Cabinet of Ministers Resolution No. 164 prohibits notarial enforcement writs based on credit agreements which were not notarised. Section XIII, paragraph 10-2, of Ukraine’s Enforcement Proceedings Law also restricts the opening of proceedings based on such writs. The agreement type, date of the writ and date when proceedings began are therefore central.

The restriction on opening new proceedings should not be mistaken for an automatic termination of all older enforcement cases. Where deductions continue under an earlier writ, its validity and the lawfulness of individual enforcement measures require separate review.

Important. Successfully challenging an enforcement writ does not, by itself, extinguish the underlying credit agreement or cancel any lawfully established debt.

REPRESENTATION IN COURT

Court claim to declare a notarial enforcement writ unenforceable

The standard remedy is generally a court declaration that a specific notarial enforcement writ is not subject to enforcement. The defendant is usually the creditor named as the beneficiary of the writ, not the notary. The notary and, depending on the circumstances, the enforcement officer may participate as third parties.

Our lawyers obtain and analyse the documents, examine the validity and amount of the claim, prepare pleadings and evidentiary applications, and consider jurisdiction. Under Article 28(12) of the Civil Procedure Code, such claims may also be filed at the place of enforcement.

01 / RECORDS

Obtain enforcement documents

The writ, enforcement orders, credit agreement, debt calculation and proof of assignment.

02 / COURT CLAIM

Prepare the claim and evidence

Define the proper legal remedy, defendant, jurisdiction, supporting materials and procedural risks.

03 / PROTECTION

Apply to suspend collection

Where justified, submit a separate application for interim relief suspending recovery under the challenged document.

04 / AFTER JUDGMENT

Address the enforcement consequences

Follow up with the officer once judgment becomes final and review steps concerning account freezes and collected funds.

IMMEDIATE FINANCIAL PRESSURE

How to suspend collection while challenging a notary writ

Filing a claim does not automatically stop an existing enforcement case. Article 150(1)(6) of the Civil Procedure Code allows an application for interim relief suspending collection based on an enforcement document challenged by the debtor, subject to the court’s assessment.

If relief is granted, the order must be communicated to the enforcement officer. Suspension of collection and lifting every account freeze are not necessarily the same legal result. The existing enforcement orders and the origin of the frozen funds must also be reviewed.

RECOVERING FUNDS

Can money collected under an unenforceable writ be returned

Where funds have already been transferred to the creditor, a separate restitution claim may be available once the legal basis for retention no longer exists, including under Article 1212 of the Civil Code of Ukraine. A favourable judgment about the writ does not invariably trigger an automatic refund.

We check the amounts actually transferred, the recipient and the supporting financial records. Claims against the creditor and challenges to the enforcement officer’s orders are distinct procedures and may require different evidence.

FREQUENTLY ASKED QUESTIONS

Questions about Ukrainian notarial enforcement writ challenges

What is a notarial enforcement writ in Ukraine?

It is an enforceable document issued by a notary on qualifying documents evidencing debt. It is not a court judgment and can be challenged before a court.

Can a notarial enforcement writ be challenged?

Yes. The usual remedy is a declaration that the specific writ is not subject to enforcement. Grounds and prospects depend on the agreement, dates and creditor evidence.

Who should be the defendant in court?

Generally the creditor benefiting from the writ. The notary, and potentially the enforcement officer, may participate as third parties.

Must proceedings be brought where the notary works?

No. Alongside ordinary jurisdiction rules, Article 28(12) of the Civil Procedure Code permits claims at the place where the writ is enforced.

Does filing a claim immediately stop collection?

No. A separate application for interim relief may be needed, and the court must make an order.

Can I challenge a writ involving an online microloan?

Yes. We assess whether the loan was notarised, the date of the writ and whether the creditor supplied the legally required documents.

Are these writs permitted during Ukrainian martial law?

Specific restrictions apply to non-notarised credit agreements and opening enforcement proceedings based on the resulting writs. The exact timeline is important.

Where can I obtain the writ number?

Check your enforcement opening order or request information from the enforcement officer and the relevant Ukrainian enforcement records.

What if my Ukrainian bank account is frozen?

First identify the underlying document and enforcement case. A writ challenge, an application to suspend recovery and measures concerning the freeze are distinct remedies.

Will I recover money already taken?

Recovery may be possible where the legal requirements are met, but it is not automatically achieved by a successful challenge to the writ.

Does a successful challenge cancel my loan?

Not necessarily. It addresses the enforceability of the particular notarial writ, rather than automatically eliminating all underlying contractual obligations.

Is there a time limit for a court claim?

Limitation periods and their starting point depend on the relief, relevant events and applicable legislation. We review this against the documents rather than assume one date.

Can you assist me from outside Ukraine?

Much of the initial review and preparation can be handled remotely. Representation and procedural formalities are organised case by case.

How much will legal representation cost?

Fees depend on the documents, the procedural stage, the need for interim relief and the scope of court representation. They are agreed following assessment.
