WHEN YOU NEED HELP

Debt collection lawyer and borrower protection in Ukraine

Debt collection defence is not limited to cases where a bank has instructed a collection agency. People also need assistance when they receive calls about someone else’s loan, when private financial information is disclosed, or when collectors threaten them or present inconsistent payment demands.

We begin with the facts and documents. We identify the lender or collector, review the claimed amount and establish what actually occurred. The purpose is to distinguish lawful recovery of a debt from unlawful pressure and to select practical remedies under Ukrainian law.

01 / CALLS

Repeated calls and messages

Contact at prohibited times, excessive frequency, aggressive messages or improper psychological pressure.

02 / THIRD PARTIES

Pressure on relatives or employers

Disclosure of credit information or contact with third parties without the required legal basis or consent.

03 / WRONG PERSON

Demands for someone else’s debt

You did not borrow or guarantee the loan, yet your phone number appears in a collector’s records.

04 / DISPUTED CLAIM

Unclear collector or inflated demand

No reliable documents confirming the creditor’s rights, the calculation or the loan itself.

RULES FOR CREDITORS

What debt collectors are prohibited from doing in Ukraine

Article 25 of Ukraine’s Law on Consumer Lending sets standards of ethical conduct for lenders, debt purchasers and registered collection companies when resolving overdue consumer credit. These rules prohibit threats, blackmail, unlawful pressure, attacks on dignity and disclosures of debt information to unauthorised persons.

There are also restrictions on the times and frequency of contact, obligations to identify the person making contact, and safeguards for personal data. A proper legal assessment requires evidence of who contacted whom, when and why, and on what legal basis.

01

Threats and intimidation

A collector cannot lawfully threaten violence, use blackmail or subject a borrower or their family to unlawful psychological pressure.

02

Calls at prohibited times

For overdue consumer lending, Ukrainian law generally restricts contact between 8 p.m. and 9 a.m. and on weekends and public holidays.

03

Frequency and privacy

National Bank of Ukraine rules further limit certain contacts and protect third parties from unauthorised interaction.

Important. Even where repayment is overdue, the borrower retains legal protections. However, unlawful collection conduct does not automatically extinguish the underlying debt.

EVIDENCE FIRST

How we examine a collector’s legal authority

A company may be an external collection agency, a purchaser of the debt, or an agent of the original lender. These are not the same legal roles. We check the loan agreement, notices of assignment, payment history, calculation of the debt and, where relevant, the NBU register of collection companies.

We also examine call recordings, chat messages, screenshots, call logs and contact with family members. Where key records are held by a lender or finance company, we identify the appropriate way to request them. This allows us to distinguish substantiated claims from amounts or practices that can be challenged.

FROM REVIEW TO ACTION

How MAGISTERS handles debt collection disputes

01 / FACTS

Review the circumstances

We examine the agreement, communications, lender records, payment evidence and exact demands.

02 / ASSESSMENT

Identify breaches

We analyse contact rules, authority to collect, data protection issues and debt calculations.

03 / DOCUMENTS

Prepare formal measures

We draft notices and complaints to the lender, the collector and the NBU; police reports may be appropriate in serious cases.

04 / REPRESENTATION

Pursue the chosen remedy

We conduct negotiations and, where required, prepare a defence to a credit claim or relevant court proceedings.

COMPLAINTS AND REMEDIES

Where to report unlawful collection practices

Complaints about violations of ethical conduct in overdue consumer credit may be addressed to the relevant lender or collection company and to the National Bank of Ukraine, which supervises this area. A useful complaint identifies specific incidents, dates, phone numbers and supporting messages or recordings.

Threats of violence, extortion or other possible offences may justify reporting the matter to the police. Disputes over the debt balance, contract validity or private-law remedies may require litigation. These procedures serve different purposes: an NBU complaint does not replace a response to a bank’s court claim.

PROTECTING YOUR FAMILY

Collectors calling relatives or contacting your employer

A number appearing in a borrower’s contacts list does not itself authorise a collector to disclose debt information or demand payment from that person. We review whether the person may lawfully be contacted, whether the necessary consent exists, what was disclosed and whether contact has been expressly prohibited.

We document who was contacted, what was said and which personal data may have been improperly used. Where supported by the evidence, we prepare formal demands and regulatory complaints.

SOMEONE ELSE’S LOAN

What if you are being pursued for another person’s debt

If you are neither the borrower nor a guarantor and have no other legal obligation for the loan, collection calls alone cannot make you liable. Avoid sending identification documents, disclosing personal details or paying a third party simply to make the calls stop.

We identify the caller, establish why your number is being used and examine the nature of the demand. Appropriate measures may include demands to stop unlawful contact or data processing and a complaint to the relevant authority.

DEBT PURCHASES AND CLAIMS

When a debt is sold or the lender has filed a lawsuit

An assignment to a financial company does not automatically cancel the debt, nor does it prove that every amount the new creditor requests is correct. We review evidence of the assignment, loan terms, payments and accrued charges. If court proceedings are pending, we consider procedural deadlines and examine the claimant’s evidence.

Where enforcement proceedings have already begun or bank accounts have been frozen, we separately assess the enforcement instrument and the bailiff’s actions. Those measures require their own legal analysis and should not be confused with a complaint about threatening calls.

FREQUENT QUESTIONS

Frequently asked questions about debt collection defence

What is an anti-collector lawyer?

This is a descriptive term for a lawyer who protects borrowers or third parties against unlawful debt collection practices. It is not a separate professional licence in Ukraine.

Can a collector contact my family?

Not without regard to statutory restrictions. The legal basis for contact, any consent, and the information disclosed must be examined in the specific circumstances.

What if collectors call every day?

Preserve your call log, messages and recordings and note the time and frequency of contact. These details can support an assessment of regulatory breaches and a formal complaint.

Can collectors threaten to sue me?

A truthful statement that court proceedings may be commenced is not automatically unlawful. Threats of violence, extortion or deliberately false claims about immediate seizure are different.

Can a collection agency freeze my account?

It cannot impose a court or enforcement seizure on its own. Account restrictions require the appropriate legal process and supporting enforcement documentation.

Does an NBU complaint cancel my loan?

No. Regulatory complaints address conduct and consumer protection issues. They do not automatically extinguish repayment obligations.

How can I check a collection company?

Where applicable, we review the NBU register and the legal basis on which the company acts. A registered collector and a new creditor purchasing the loan are not necessarily the same thing.

What if someone took out a fraudulent loan in my name?

Do not admit liability without reviewing the evidence. Preserve the documents and assess notification to the lender, the police and, if necessary, the court.

Can a lawyer negotiate a lower repayment amount?

Disputed unlawful charges may be challenged, and repayment terms can sometimes be negotiated. The options depend on the contract, relevant dates, evidence and creditor consent.

Can you help if the lender has already sued?

Yes. We can review the court file, response deadlines, evidence of loan disbursement and the calculation. This is a related but distinct form of credit litigation.

Can you act for clients living abroad?

Many initial steps, document reviews and communications can be handled remotely. Court or formal procedural requirements are assessed individually.

How much does debt collection defence cost?

Fees depend on whether the matter involves a consultation, formal complaint, loan review, negotiations or litigation. Scope and fees are agreed after the initial review.
