HOW TO BEGIN
How to claim child support in Ukraine
A court order may be available for legally defined claims if paternity is not contested and no other interested parties need to be joined. More complex claims must be brought through ordinary civil proceedings.
After judgment, check actual payments, the income used for calculations, accumulated arrears and enforcement actions. A judgment alone does not guarantee receipt of funds.
LEGAL ASSISTANCE
What child support disputes do we handle
Some claims can be resolved through a streamlined court order, while others require a full lawsuit. In many cases the main problem starts after judgment, when the payment order needs to be enforced.
01
Applying for child support
Prepare an application for a court order or a lawsuit and gather the necessary evidence.
02
Increasing child support
Assess changing family circumstances, genuine income and the child’s needs.
03
Reducing child support
Examine the legal grounds and evidence for a change in the payment amount.
04
Child support arrears
Review arrears calculations and the steps taken by enforcement officers.
05
Late-payment penalties
Calculate and claim statutory penalties where the legal conditions are met.
06
Extraordinary child expenses
Seek a parent’s contribution to qualifying additional costs arising from special circumstances.
COURT PROCEDURES
Court order or child support lawsuit
The appropriate procedure depends on the nature of the claim. Article 161 of the Civil Procedure Code of Ukraine sets out the limited categories eligible for a court order. Disputed or more complex claims require ordinary civil proceedings.
01
Court order
Available for the statutory share of income or a fixed amount equal to 50% of the child’s age-based subsistence minimum where procedural requirements are met.
02
Lawsuit
Used where evidence must be examined, the amount disputed or a previous support order changed.
AMOUNT OF CHILD SUPPORT
How is child support calculated in Ukraine
Ukrainian law allows support as a share of income or as a fixed amount. The court considers the child’s needs, each parent’s means and other factors under Article 182 of the Family Code. Statutory percentages are not automatic outcomes in every dispute.
| For the court-order procedure | |
|---|---|
| One child | One quarter of income |
| Two children | One third of income |
| Three or more | One half of income |
These shares apply to the statutory court-order procedure under Article 183 of the Family Code and Article 161 of the Civil Procedure Code, subject to a cap of ten age-based subsistence minimums per child. The guaranteed minimum is 50% of the child’s age-based subsistence minimum.
UNPAID SUPPORT
Child support arrears and late-payment penalties
If a court order exists but payments are missing, we examine the enforcement file, arrears calculation and available information on the payer’s income and assets. Inaction by an enforcement officer may be challenged.
01
Arrears assessment
Check payment periods, credited amounts and the rules used where no verified income is available.
02
Statutory penalty
Article 196 may allow a 1% daily late-payment penalty subject to fault, calculation rules and statutory limits.
03
Enforcement measures
Assess attachments, restrictions and other available enforcement tools in the individual case.
CHANGING PAYMENTS
Increasing reducing or changing child support payments
A material change in finances, family circumstances or health may support an application to vary payments. A new child or loss of formal employment does not automatically change an existing order. Courts assess the evidence.
01
For the receiving parent
Document growing expenses, the child’s needs and the payer’s financial resources.
02
For the paying parent
Assess genuine changes in means, health and family circumstances.
03
Changing the method
Consider switching between a percentage of income and a fixed payment under Ukrainian law.
COSTS BEYOND REGULAR SUPPORT
Additional expenses for a child may be claimed separately
Article 185 of the Family Code provides for both parents to contribute to additional costs arising from special circumstances. Medical treatment, development of abilities and other qualifying needs require evidence. Normal everyday living costs do not automatically qualify.
01
Medical expenses
Assess evidence for treatment, dental care, rehabilitation and other special needs.
02
Development and education
Document special circumstances and related educational or developmental needs.
03
Method of reimbursement
The court may order advance contributions or reimbursement, in one payment or periodically.
CROSS-BORDER CASES
Child support when a parent lives abroad
Living outside Ukraine does not automatically end the legal duty to support a child. The applicable international convention, competent court and recognition or enforcement procedure must be determined.
We help identify the correct route, documents and translations for the relevant country. Enforcement abroad depends on local law and applicable treaties; no outcome can be guaranteed.
EVIDENCE
Documents required for a child support case
Commonly relevant records include the child’s birth certificate, information about residence and care, any existing agreement or judgment, proof of payments and income details. A dispute about the amount may also require proof of the child’s expenses and a parent’s assets.
If income is hidden or earned abroad, we identify lawful ways of obtaining evidence. Lack of formal employment does not by itself remove child-support obligations.
RIGHTS OF BOTH PARENTS
Oversight of child support spending
Support payments belong to the child, but the paying parent does not automatically have a right to demand a receipt for every purchase. Article 186 of Ukraine’s Family Code provides for oversight by the guardianship authority in specified circumstances.
Where misuse is established, the law provides for specific court remedies, potentially including a reduced payment or allocation of part of it to the child’s own account.
TIMING OF CLAIMS
Can child support be claimed for previous years
As a rule, child support is awarded from the date of filing. Article 191 permits recovery for a limited previous period, up to three years, where its conditions and supporting evidence are satisfied.
This is different from enforcing arrears under an existing judgment or enforcement document, which is governed by separate rules including Article 194.

QUESTIONS AND ANSWERS
Frequently asked questions about child support
Can I claim child support without getting divorced?
Yes. A parent’s duty to maintain a child does not depend on divorce.
Is a court case always necessary?
No. Parents may enter into a notarised maintenance agreement.
What percentage of income is paid for one child?
The statutory court-order route provides for one quarter of income subject to a cap. A contested lawsuit may lead to a different assessed amount.
What if the payer is officially unemployed?
Unemployment does not cancel the duty to maintain a child. Special rules apply when calculating arrears.
Can an existing award be increased?
Yes, where legally relevant changes are established and supported by evidence.
Does a second child automatically reduce payments?
No. The court assesses all circumstances.
How can unpaid support be recovered?
An enforcement assessment is needed to examine the order, arrears and enforcement officer’s actions.
Can late-payment penalties be claimed?
Article 196 provides for a penalty in qualifying circumstances with statutory limitations.
Can medical expenses be claimed separately?
Yes, if the expenses arise from special circumstances and are proven under Article 185.
Must the receiving parent provide every receipt?
No general duty applies; Article 186 provides a separate guardianship oversight procedure.
Can I enforce an order when the payer is abroad?
It depends on the country, applicable treaties and enforcement procedure.
Can support continue after age 18?
Certain adult children in education may qualify for maintenance up to age 23 under Article 199.
